Woman Crashes Car When Praying While Driving

There are laws in Florida about texting while driving, and for good reason. Anything a person does to take their eyes off the road can lead to an accident and when you double up with something distracting – like texting – it’s a recipe for disaster. But a recent story in the NWF Daily News really put a new spin on distracted driving.
The article is titled Woman who was driving while praying with her eyes closed hits house and the story follows much as you’d expect from that headline.
Adrian Mijangos writes, “A 28-year-old woman was taken to the hospital for evaluation after driving into a Mary Esther house Thursday morning. The woman told Okaloosa County Sheriff’s Office deputies she was praying at the time and had her eyes closed, according to the OCSO.
The Fort Walton Beach woman was traveling eastbound on Marcia Drive when she failed to stop at a stop sign, went through an intersection and into the yard of a home on Miramar Drive. She tried to back out but got stuck in the sand, the OCSO said. She was cited for reckless driving with property damage. No one in the house was injured.”
At the Law Offices of Gilbert & Smallman, we’ve served people in the Miami and Fort Lauderdale area for decades and while we’ve seen most everything, we must admit we’ve never seen a case like this before. The question of course is this: who is responsible for the damages to the home this woman hit?
Based on the information in the article, this seems to be a pretty cut and dry case. Though the woman who struck the house with her car likely didn’t intend any damage, she was clearly negligent in taking her eyes off the road. Luckily no one in the home was injured. If they had been, they’d likely have a strong personal injury case.
